Legal & Other Requirements

PURPOSE

  • 1.1 The purpose of this procedure is to establish a detailed process:
    • 1.1.1 To identify legal requirements applicable to SIPL and other requirements to which SIPL subscribes, and to have access to these regulations.
    • 1.1.2 To track any changes in these legal and other voluntary requirements, including any new legislation which may become applicable in future.
    • 1.1.3 To ensure and monitor compliance with these legal and other requirements.

  • 2.1 This SOP applies to all applicable acts, rules & regulations and other requirements related to SIPL.

PROCEDURE

  • 7.1 The applicable legislation, regulations and other requirements are identified by the Unit Head & MR using the following methodology:
    • 7.1.1 Reference to pollution control acts, rules and notifications issued thereunder by the Central and State Pollution Control Board, Factory Inspectorate, FSSAI, Drugs Departments etc.
    • 7.1.2 Requirements identified during implementation of adopted management systems.
    • 7.1.3 Communication from industrial associations etc.
  • 7.2 During identification of the legal and other requirements, environmental aspects, product safety hazards & other requirements are also reviewed.
  • 7.3 FDA related requirements are reviewed and liaison with the department is kept to ensure any changes in the legal requirements are captured.
  • 7.4 The team reviews the legislation and identifies the legislation, obligation and responsibility applicable to the company. The register for legal requirements is
  • 7.5 Other requirements are identified through communication received from customers, industrial associations, local bodies etc. The other requirements may include requirements of management, such as no tree to be cut in the plant area.
  • 7.6 The legal and other requirements are identified in the Legal Register. The register also describes the applicability of legal requirements on environmental aspects.
  • 7.7 The MR ensures implementation of these other requirements through respective department heads.
  • 7.8 The applicable consents are obtained / renewed from regulatory authorities as per the prescribed frequencies as mentioned in the Legal Register and in the consent / authorization / license.
  • 7.9 To get information on new requirements / draft legislation etc.:
    • 7.9.1 The MR maintains regular contact with the consultants.
    • 7.9.2 Subscription to related bulletins.
    • 7.9.3 Regular checking of CPCB / SSPCB websites.
  • 7.10 Review the information quarterly about amendments / additions to the acts / rules and regulations, and update the register whenever a change in the related acts / rules / regulations is received.
  • 7.11 As and when any amendment to acts / rules / regulations is received, review the amendment and, if applicable, update the register.
  • 7.12 If any other requirements are identified, e.g. from customers, suppliers, employees and/or community, they are reviewed and recorded as above.
  • 7.13 Compliance with legal and other requirements is monitored by the MR and Unit Head on a quarterly basis.
  • 7.14 The legal and other requirements are communicated to the persons in the organization through distribution of the EIA & Legal Register. Lateral communication is through contracts / letters or informally.
